Our first post addresses a unique feature of Illinois law – no comprehensive general liability coverage for construction defects. The case law in both state and federal courts is settled. There is no coverage for defective construction claims where the claim is for damage to only the building itself. If there is damage to something other than the building then that property may be covered.
This rule of law is not present in Wisconsin or Indiana. Under Wisconsin and Indiana law comprehensive general liability policies provide coverage to contractors for construction defects. It is an oddity in Illinois.
